Probate

For estates over $150k where a decedent had no trust

If an estate is valued at more than $150,000.00 at the time of a decedent’s death, that estate may have to be probated. “Probate” comes from one of those Latin words that lawyers love to use.  Basically it means “to prove.” When you leave a will, someone has to prove to a court that the will is valid. Furthermore, if someone dies without a will or any other estate plan, the probate court still needs to decide who inherits from the decedent and what debts are to be paid.

Trust Administration

The formation of a living trust is an important step for anyone wishing to keep assets out of probate for purposes of cost and efficiency, avoid assessment of substantial estate taxes, or establish long-term management of various types of property.  However, upon the death of a loved one, a trust must be administered.

The laws governing proper trust administration change frequently. We stay abreast of all current laws in order to assist surviving spouses and others serving as trustees with issues such as:

It is vital that you understand your current liabilities & potential liabilities so you can put the necessary plans in place to mitigate your risk. Asset protection is commonly misunderstood & underestimated.

Our clients have invested so much of their time & money earning their assets, but many need help to maintain & protect them against a number of risks & vulnerabilities such as:

Business Planning

It does not matter if you are shareholder in a corporation, a member in an LLC, or a sole proprietor, in the event of your death or incapacity your business will be unable to thrive without the proper person in place to continue the business.

An attorney with expertise in business and estate planning can help owners and shareholders put together a plan that facilitates a smooth transition. Plans are customarily created after employees, coworkers, shareholders and family members have been consulted and goals for the future of the company have been outlined.

Conservatorships & Guardianships

Conservatorships are legal relationships that grant one adult the right and obligation to care for another. California law recognizes separate conservatorships for basic care and protection (conservatorship of the person) and financial management (conservatorship of the estate). A conservator of the person is generally responsible for: meals, housekeeping & personal care; recreation, shelter & transportation; health & general well-being.

Did your grandchildren’s parents pass away, and you need help becoming their legal guardian? Were assets left out of a deceased parent’s estate that now need to be managed until a child is of age? Voorhees Law Group works to appoint guardians of minor children and estates when parents pass away unexpectedly.
